Judge Rules Insurance Mandate in Health Reform Unconstitutional

A federal judge in Virginia ruled earlier this week that the insurance mandate present in healthcare reform is unconstitutional.

“The judge, Henry E. Hudson of Federal District Court in Richmond, said the law’s requirement that most Americans obtain insurance exceeded the regulatory authority granted to Congress under the Commerce Clause,” The New York Times reported.

Hudson became the first judge to invalidate one of the law’s components; however, he also denied the plaintiff’s request to suspend implementation of the law, “meaning there should be no immediate effect on its rollout,” The New York Times reported.
